Synopsis

This academic work offers a comprehensive and systematic study of the intermediate stage in the Peruvian accusatory criminal justice system, characterizing it as a critical "hinge phase" that guarantees the transition of cases with sufficient merit to the oral trial. Through nine chapters, the author analyzes the conceptual density of this stage as the primary filter for the process, where formal and substantive controls are exercised over the prosecution's case to safeguard fundamental rights such as the presumption of innocence and the right to a defense. The research stands out for its up-to-date approach, integrating the analysis of recent regulatory changes—such as Law No. 32130 of 2024—and jurisprudential criteria from the Supreme Court and the Constitutional Court, addressing practical challenges such as procedural efficiency and the correction of procedural defects before trial. In short, the book constitutes an indispensable technical tool for understanding the functioning and operational challenges of this procedural segment in contemporary Peru.
